Abstract

The main purpose of this research is to study receiving complaints of police officers when a victim makes a factual complaint to the police. This is considered as the first step in the judicial process, but it turned out that the police exercised their discretion to dismiss the complaint without justification. According to the Criminal Procedure Code, the police have the responsibility to accept complaints of criminal offenses. To protect the rights of the victims and achieve justice for the victims, the purpose of this article is to provide guidelines for determining the proper process for helping victims when a police officer refuses to take complaints. In other words, there should be a measure or procedure in place to appeal a police officer’s denial of wrongdoing as a review of illegal activity, checks and balances of power, including discrimination, which makes the judicial process more efficient. Furthermore, the Code of Criminal Procedure should be amended to allow victims to appeal the refusal by a police officer to accept a complaint in the interest of criminal justice.
