Problems on the Protection of Movie and Book Titles Under Copyright and Trademark Law

Titles of movies and books are a significant issue discussed at the international conference of the Commission on Trademarks, Industrial Designs, and Geographical Indications, regarding the protection of intellectual property rights. This raises the question of whether the intellectual property rights of movie and book titles are protected under copyright or trademark law. Through the study of theories, principles, international laws, foreign laws, and Thai laws, both in terms of copyright and trademark law, it was found that, in terms of theories, principles, and copyright law, it is not possible to protect the titles of movies and books such as literary works under copyright law. However, when analyzing theories, principles, and trademark law, it was found that it is appropriate, and the law allows for the provisions of trademark law to be used to protect the titles of movies and books. However, considering the provisions of Section 4 of the Trademark Act B.E. 2534, as amended by the Trademark Act (No. 3) B.E. 2559, it was found that there is a need to amend the definition of the term “trademark.” This amendment aims to expand the scope of trademark protection to cover new forms of trademarks, including those for movie and book titles.
