Abstract

This academic article aims to present a conceptual framework of the legal intent underlying enterprise compliance with labor laws in Thailand, particularly under the Labour Protection Act B.E. 2541 (1998) and its subsequent amendments. In this perspective, compliance with labor law should not be understood merely as an outcome of state enforcement; rather, it is the product of an institutional process that systematically integrates legal provisions, labor policies, and organizational behavior. Drawing upon a comprehensive review and synthesis of relevant concepts and theories, the article elucidates the mechanisms and conditions that facilitate either compliance with or violations of labor laws. The conceptual analysis indicates that the level of labor law compliance among enterprises is contingent upon the alignment of three principal dimensions. First, the legal dimension functions as a framework that establishes minimum standards concerning labor rights and obligations. Second, the policy and enforcement dimension translates statutory provisions into actual practice through labor inspection systems, incentive measures, and sanctions. Third, the organizational behavior dimension reflects how enterprises interpret, perceive, and adapt to legal and policy requirements under constraints of resources and competitive pressures. When these three dimensions mutually reinforce one another, institutional coherence is achieved. Conversely, a lack of alignment may generate a gap between legal prescriptions and actual practices, thereby leading to non-compliance with labor laws. The article further suggests that the state should recalibrate its role from relying predominantly on coercive enforcement toward designing institutional policies and mechanisms that foster voluntary compliance, while simultaneously upholding labor protection standards. Such an approach would contribute to enhancing the quality of employment, strengthening organizational sustainability, and reinforcing the legitimacy of the state within the overall labor governance system.
