บทคัดย่อ

การวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาและวิเคราะห์ปัญหาในการสืบสวนและดำเนินคดีกับแฮ็กเกอร์ที่อยู่ในต่างประเทศภายใต้กฎหมายไทย วิธีการในการวิจัยปัญหาดังกล่าวได้ใช้วิธีการวิจัยเชิงคุณภาพ โดยการรวบรวมข้อมูลต่าง ๆ จากตัวบทกฎหมาย หนังสือ บทความวิจัย บทความทางวิชาการ รายงาน ข่าวประจำวัน ทั้งในประเทศไทยและต่างประเทศ ข้อมูลจากเอกสารทั้งหมดนี้ได้ถูกนำมาใช้ในการวิเคราะห์ถึงปัญหาและอุปสรรคในการดำเนินคดีกับแฮ็กเกอร์ที่อยู่ในต่างประเทศ ข้อมูลเหล่านี้ยังถูกนำมาใช้ในการอธิบายแนวคิดหรือหลักเกณฑ์ในการดำเนินคดีกับแฮ็กเกอร์ที่อยู่ในต่างประเทศด้วยเช่นกัน

การวิจัยพบว่าปัญหาในการดำเนินคดีกับแฮ็กเกอร์ที่อยู่ในต่างประเทศมิได้เกิดจากพระราชบัญญัติว่าด้วยการกระทำความผิดเกี่ยวกับคอมพิวเตอร์ พ.ศ. 2550 แต่อย่างใด ซึ่งในความเป็นจริง พระราชบัญญัติว่าด้วยการกระทำความผิดเกี่ยวกับคอมพิวเตอร์ พ.ศ. 2550 เป็นกฎหมายที่มีประสิทธิภาพ แต่ปัญหาเกิดจากพนักงานเจ้าหน้าที่ขาดความรู้และไม่มีความสามารถในการดำเนินคดีกับแฮ็กเกอร์ที่อยู่ในต่างประเทศ นอกจากนี้ ปัญหายังรวมถึงการสืบสวน สอบสวน และรวบรวมพยานหลักฐานดิจิทัลที่อยู่ในต่างประเทศภายใต้พระราชบัญญัติความร่วมมือระหว่างประเทศในเรื่องทางอาญา พ.ศ. 2535 และการขอให้ส่งตัวแฮ็กเกอร์ที่อยู่ในต่างประเทศมายังประเทศไทยในฐานะผู้ร้ายข้ามแดนภายใต้พระราชบัญญัติส่งผู้ร้ายข้ามแดน พ.ศ. 2551

การวิจัยนี้เสนอวิธีการแก้ไขปัญหาในการดำเนินคดีกับแฮ็กเกอร์ที่อยู่ในต่างประเทศ ด้วยการพัฒนาศักยภาพและความสามารถของพนักงานเจ้าหน้าที่ในประเทศไทย การเข้าร่วมในความร่วมมือระหว่างประเทศ และการลดขั้นตอนหรือกระบวนการทางกฎหมาย
