Abstract

The study employed a qualitative research design. This is a overall study and analysis of document information. The goals were to: 1) Investigate the concept, they history, status, and development of the rule of law in the French Republic and Thailand; 2) examine how the rule of law is applied in administrative court decisions; 3) study the principles of rulings and judgments, orders issued by Thailand’s Supreme Administrative Court and 4) provide guidelines for developing, improving, and amendment administrative legal principles. The research findings revealed that: 1) the concept of law and government has existed since the time of the ancient Greeks and Romans, which is an important foundation for the emergence of the rule of law. Important concepts in the rule of law to limit the states or ruler’s power within the law’s scope do not use power arbitrarily to deprive people of their rights and freedoms without good reason. Moreover, it is accepted that in France, the “Council of State” is a highly successful institution, and the French Republic is considered on model for the Thai Administrative Court. 2) The Supreme Administrative Court has taken the principles of the law inti consideration in principle of legality apply to all types. As the saying goes, “No law, no authority”. At present, the rule of law has two important components: the from component (binding oneself to the law) and elements in content. To ensure fairness, the use of state power must be regulated. State justice is the rule of law. 3) in the judgment of the Supreme Administrative Court, important, problems were found in the uncertainty and ambiguity of existing laws. In some cases, the Supreme Administrative Court was unable to directly consider the existing guidelines for promoting in deciding the fines. Therefore, legal principles that are very similar must be compared, as must guidelines of promoting knowledge in order to develop and support the administrivia justice process, such as promoting institutions and developing curricula. Create knowledge Become an expert. Promote learning and disseminate the resulted of administrative court judgment or orders. And improving existing laws to make them clearer. Certainly, in light of the current situation, it should be beneficial to maintain important guarantees for protecting people’s rights and freedoms, as well as public benefits, with the Thai Administrative Court has always done to create a balance between public benefits and private damages.
