“ผู้พิพากษาไทยใช้ค้อนในห้องพิจารณาคดีเหมือนในต่างประเทศหรือไม่?” “ผู้พิพากษาไทยเก็บค้อนไว้ตรงไหน?” “หากไม่มีค้อนแล้วผู้พิพากษาจะควบคุมการพิจารณาคดีอย่างไร?” คำถามเรียบง่ายที่ผู้เขียนมักได้รับจากบุคคลทั่วไป นำไปสู่คำถามต่อไปว่าอะไรคือสิ่งที่สะท้อนถึงอำนาจและความชอบธรรมของอำนาจตุลาการในบริบทประเทศไทย บทความนี้มุ่งเล่าเรื่องประวัติศาสตร์และบทบาทของค้อนในกระบวนยุติธรรมในอดีตจนถึงปัจจุบัน ตลอดจนวิเคราะห์ผ่านทฤษฎีความเอนเอียงเชิงบวก (Positivity Theory) ที่นำเสนอว่าสัญลักษณ์และพิธีกรรมของศาล เช่น ชุดครุย ค้อน อาคารศาลที่โอ่อ่าเสมือนวิหาร คำเรียกขานและพิธีกรรมยกย่อง เป็นต้น เป็นปัจจัยที่สามารถสร้างความรู้สึกเชิงบวกของประชาชนที่มีต่ออำนาจตุลาการตลอดจนเพิ่มการยอมรับต่อคำพิพากษาแม้ในกรณีที่ประชาชนอาจไม่เห็นด้วยกับผลลัพธ์ของคดีโดยไม่ต้องพิจารณาเหตุผลอย่างลึกซึ้ง อย่างไรก็ตามบทความนี้ชวนผู้อ่านตั้งคำถามต่อไปว่าสิ่งที่ช่วยเสริมสร้างความชอบธรรมและความเชื่อมั่นศรัทธาต่ออำนาจตุลาการแท้จริงแล้วคือสิ่งใดกันแน่
