สถานะทางกฎหมายระหว่างประเทศซอฟลอว์: กรณีศึกษาประมวลกฎต่อต้านการใช้สารต้องห้ามโลก 2021

บทความนี้มีวัตถุประสงค์ที่จะศึกษาสถานะทางกฎหมายและกลไกการทำงานของประมวลกฎต่อต้านการใช้สารต้องห้ามโลก (World Anti-Doping Code 2021) ภายใต้มาตรา 4 วรรคสอง อนุสัญญาว่าด้วยการต่อต้านการใช้สารต้องห้ามทางกีฬา ค.ศ. 2005 เพื่อพิจารณาประเด็นเรื่องสถานะความเป็นกฎหมายซอฟลอว์ในกฎหมายระหว่างประเทศว่ามีผลผูกพันและสามารถบังคับใช้กับรัฐได้อย่างไร เพื่อศึกษาแนวคิดสถานะทางกฎหมายระหว่างประเทศซอฟลอว์และกรณีศึกษาประมวลกฎอื่น เพื่อศึกษาและวิเคราะห์ผลกระทบที่ตามมาจากการปฏิบัติไม่สอดคล้องกับประมวลกฎต่อต้านการใช้สารต้องห้ามโลก รวมถึงเสนอแนะแนวทางการปรับปรุงแก้ไขประเด็นที่ยังปฏิบัติไม่สอดคล้องกับประมวลกฎต่อต้านการใช้สารต้องห้ามโลก 2021 ซึ่งผลการศึกษาพบว่าประมวลกฎต่อต้านการใช้สารต้องห้ามโลก 2021 มีสถานะเป็นกฎหมายซอฟลอว์ แม้ว่าจะเป็นภาคผนวก (Appendix) ของอนุสัญญาฯ นี้ซึ่งถือว่าไม่มีนัยสำคัญทางกฎหมายและไม่มีข้อผูกพันตามกฎหมายระหว่างประเทศกับรัฐภาคีก็ตาม แต่หน่วยงานต่อต้านการใช้สารต้องห้ามทางกีฬาแห่งชาติในฐานะผู้ลงนามต้องผูกพันกับประมวลกฎต่อต้านการใช้สารต้องห้ามโลก 2021 นี้ ดังนั้น การไม่ปฏิบัติตามประมวลกฎต่อต้านการใช้สารต้องห้ามโลก 2021 ในบริบทของกฎหมายระหว่างประเทศซอฟลอว์อาจสร้างผลกระทบต่อผู้ลงนามทั้งโดยตรงต่อบุคคล ต่อหน่วยงานต่อต้านการใช้สารต้องห้ามทางกีฬาแห่งชาติและต่อรัฐ รวมถึงผลกระทบโดยอ้อมทางสังคม เศรษฐกิจและประโยชน์อื่นในอุตสาหกรรมกีฬากับประเทศสมาชิกได้
ในส่วนแรกของบทความเป็นการศึกษาลักษณะและกลไกการทำงานของกฎหมายซอฟลอว์ เหตุใดรัฐจึงใช้กฎหมายซอฟลอว์ ส่วนที่สองกล่าวถึงปัญหาสถานะทางกฎหมายของประมวลกฎต่อต้านการใช้สารต้องห้ามโลก 2021 ในประเด็นการไม่มีค่าบังคับทางกฎหมายภายใต้มาตรา 4 วรรคสอง ของอนุสัญญาฯ การพิจารณาประมวลกฎต่อต้านการใช้สารต้องห้ามโลกในฐานะเป็นกฎหมายจารีตประเพณีระหว่างประเทศ รวมถึงประเด็นความสัมพันธ์ระหว่างองค์กรต่อต้านการใช้สารต้องห้ามโลก (World Anti-Doping Agency: WADA) และหน่วยงานต่อต้านการใช้สารต้องห้ามทางกีฬาแห่งชาติ (National Anti-Doping Organization: NADO) กับประมวลกฎต่อต้านการใช้สารต้องห้ามโลก (World Anti-Doping Code 2021) ส่วนท้ายกล่าวถึงผลกระทบที่ตามมาจากการปฏิบัติไม่สอดคล้องกับประมวลกฎต่อต้านการใช้สารต้องห้ามโลกและมาตรฐานสากลของหน่วยงานต่อต้านการใช้สารต้องห้ามทางกีฬาแห่งชาติระหว่างปี 2015-2021 และข้อเสนอแนะแนวทางการปรับปรุงแก้ไขประเด็นที่ไทยยังปฏิบัติไม่สอดคล้องกับประมวลกฎต่อต้านการใช้สารต้องห้ามโลก 2021
