Legal Perspective on the Human Dignity of Deceased Persons

The Constitution of the Kingdom of Thailand B.E. 2560 (2017) contains provisions that recognize human dignity for persons with a legal personality, resulting in the scope of human dignity protection not extending to cover the deceased person. Also, currently, there is a substantial number of cases considered to be human dignity violations of deceased persons in Thailand. Such problems result from provisions in the Constitution that affect the enforcement and interpretation of the entire legal system, including the human dignity of the deceased person's protection in the practice of Thailand. According to the study, the concept of human dignity in the international contexts has the scope of human dignity protection extending to cover persons with a legal personality, a fetus, and a deceased person (who still has a completed body, parts of a body, or cremated bones), and was guaranteed in the laws related to human dignity protection. Therefore, to clarify the provisions of Thai Laws and in line with the international context, which will result in the suitability of human dignity protection, the Constitution of the Kingdom of Thailand B.E. 2560 Section 4 must be amended to cover deceased persons, as well as define and implement the definition and the scope of deceased persons’ human dignity to state actors and organizations having roles and duties in the human dignity protection.
