ข้อสังเกตบางประการต่อการส่งและนำกลับคืนวัตถุอวกาศภายใต้กฎหมายอวกาศแห่งชาติฉบับปัจจุบันของประเทศออสเตรเลีย

ออสเตรเลียเป็นหนึ่งในประเทศมหาอำนาจด้านอวกาศที่มีการเริ่มต้นดำเนินกิจการอวกาศมาอย่างยาวนานนับตั้งแต่ตอนกลางของคริสต์ศตวรรษที่ 20 ในปัจจุบันอุตสาหกรรมอวกาศในประเทศออสเตรเลียมีการขยายตัวอย่างรวดเร็ว เนื่องจากได้รับการสนับสนุนจากรัฐบาลในด้านเงินทุน และการจัดตั้งองค์การอวกาศออสเตรเลียขึ้นมาเพื่อกำกับดูแลกิจการอวกาศภายในประเทศ โดยในปี ค.ศ. 2015 รัฐบาลออสเตรเลียได้ทำการทบทวนภาพรวมของอุตสาหกรรมอวกาศภายในประเทศ รวมถึงพระราชบัญญัติกิจการอวกาศ ค.ศ. 1998 ซึ่งเป็นกฎหมายกำกับดูแลการดำเนินกิจการอวกาศแห่งชาติที่ใช้บังคับอยู่ในขณะนั้น ทั้งนี้ด้วยเหตุผลทางด้านเทคโนโลยีที่เกี่ยวข้องกับอวกาศ และการประยุกต์ใช้เทคโนโลยีอวกาศภายในประเทศที่มีความก้าวหน้าล้ำสมัยจากเมื่อครั้งที่กฎหมายฉบับนี้เริ่มมีการประกาศใช้ครั้งแรกเมื่อปี ค.ศ. 1998 เป็นอย่างมาก ซึ่งการทบทวนครั้งนี้ นำไปสู่การประกาศใช้กฎหมายกำกับดูแลการดำเนินกิจการอวกาศฉบับใหม่ ได้แก่ พระราชบัญญัติอวกาศว่าด้วยการส่งและนำกลับคืน ค.ศ. 2018 นอกจากนี้ออสเตรเลียยังได้ประกาศใช้กฎหมายลำดับรองอีกจำนวน 3 ฉบับ ได้แก่ กฎเกณฑ์อวกาศทั่วไปว่าด้วยการส่งและนำกลับคืน ค.ศ. 2019, กฎเกณฑ์อวกาศว่าด้วยการส่งและนำกลับคืนโดยใช้จรวดกำลังส่งสูง ค.ศ. 2019 และกฎเกณฑ์อวกาศว่าด้วยการประกันภัยด้านการส่งและนำกลับคืน ค.ศ. 2019 บทความฉบับนี้จะได้อธิบายถึงสาระสำคัญพระราชบัญญัติอวกาศว่าด้วยการส่งและนำกลับคืน ค.ศ. 2018 และกฎหมายลำดับรองในส่วนที่เกี่ยวข้องในภาพรวม โดยการวิเคราะห์ถึงมุมมองทางกฎหมายในมิติของความสอดคล้องกับพันธกรณีระหว่างประเทศซึ่งออสเตรเลียเข้าเป็นภาคีตามสนธิสัญญาด้านอวกาศของสหประชาชาติ
