Some Remarks on the Launches and Returns of Space Objects under the Current Australian National Space Law

Australia is among the world’s spacefaring nations, with a history of active involvement in space dating back to the mid-20th century. Currently, Australia’s space industry is experiencing rapid growth, thanks to government funding and the establishment of the Australian Space Agency to oversee domestic space activities. In 2015, the Australian government conducted a comprehensive review of the domestic space industry, including an examination of the Space Activities Act of 1998, which was the national space regulatory law in force at the time. This review was prompted by advancements in space-related technologies and the application of space technologies within the country since the law’s enactment in 1998. The review led to the introduction of new space regulatory legislation known as the Space (Launches and Returns) Act 2018. In addition, Australia enacted three complementary subordinate regulations: the Space (Launches and Returns) (General) Rules 2019, the Space (Launches and Returns) (High Power Rocket) Rules 2019, and the Space (Launches and Returns) (Insurance) Rules 2019. This article aims to explain key aspects of the Space (Launches and Returns) Act 2018 and the related subordinate regulations by analyzing the legal perspective in terms of compliance with international obligations in which Australia is a party to the United Nations space treaties.
