The ASEAN Legal Measures on Import and Export Food Safety Standard: Case Bakery Study

Abstract

The aim of this research is to study the concepts, theories, and legislative measures related to food safety standards for importing and exporting through case studies of international and regional pastry products, the legislative measures related to food safety standards for importing and exporting in case studies of pastry products in the ASEAN member countries, the conditions of legal problems in ASEAN member countries related to food safety standards for importing and exporting in case studies of pastry products in the ASEAN region, and analyze solutions or improve the enforcement of legislative measures related to food safety standards for importing and exporting through case studies of pastry products in the ASEAN region. The author studied the legislative measures related to food safety standards from literature and articles in both Thai and foreign languages. Moreover, food safety standards from international countries, such as Good Manufacturing Practice, Codex International Food Standard, HACCP, ISO 22000, and Halal. Further, the author studied the European Union and internal laws of ASEAN member states about the legislative measures related to food safety standards in order to study and analyze an appropriate measure to establish ASEAN legislative measures on food safety standards.

The results of the research found that the Association of Southeast Asian Nations (ASEAN) has problems relating to setting guidelines or practices that are suitable for the environments of its member countries. The main problems are divided into 3 parts as follows: 1) The problems of the legislative measures of ASEAN member countries on food safety standards for importing and exporting pastry products consist of production, registration, import and export, penalties, and fees 2) The problems of legislative measures of ASEAN member countries on food safety standards for importing and exporting pastry products in the field of law enforcement system 3) The problems arising from the central administration not taking part in regulating the enforcement of ASEAN legislative measures on food safety standards for importing and exporting pastry products.

For guidelines and measures of the solution, the researcher suggests that the ASEAN member countries should establish ASEAN measures on food safety standards for importing and exporting pastry products to provide guidelines for member states in order to establish legislative measures on food safety standards for importing and exporting pastry products consisting of production, registration, import and export, penalties, and fees. There should be a central department to administer in order to create an effective mechanism to be used as a guideline for the further development of international law and to create ASEAN legislative measures on food safety standards for importing and exporting pastry products to be used as the international standard. This is to develop the economies and promote free trade of the member countries in the ASEAN community to be more advanced, as well as to promote the welfare of ASEAN citizens for their well-being.
