The Conclusion of International Agreements by ASEAN

After the ASEAN Charter came into enforcement in 2008, ASEAN’s legal status is officially recognized as an international organization and capable of making treaty. However, there are some interesting questionable points in ASEAN’s competence of making agreement, i.e. what kind of international agreements lie within the scope of ASEAN; who has authority to make an agreement on behalf of ASEAN; and how is the agreement-making process of ASEAN. In this article, the author has examined ASEAN conventional approach of agreement-making before the enforcement of the Charter as well as the agreement-making process after the enforcement of the Charter under the Rules of Procedure for Conclusion of International Agreements by ASEAN, which came into enforcement since 2011.
