Abstract

The Constitutional Court is important in Thai legal system. At present, The Constitution of the Kingdom of Thailand, B.E. 2560 (2017) laid down various jurisdiction of Constitutional Court. A feature is the jurisdiction on the important treaties in accordance with article 178 of the Constitution. However, the author found that there are two issues. First, the Cabinet is the only one that has the authority to propose case to the Constitutional Court. Secondly, the Constitution does not provide the Constitutional Court to render judgment before the process of consent to be bound in international law.
