The Study and Comparison of Contract Forms and Collateral for the Design Work or Construction Supervision Work

Abstract
The purposes of this research were to study and compare the contracting and guarantee formats for design or construction of supervision work of the Comptroller General's Department with those of government agencies and contractors, and to study factors affecting the preparation of contracts and guarantees for government agencies and contractors. It is an integrated research study using quantitative and qualitative research method. The population used in this research is determined to be government agencies or related agents responsible for making contracts, drafting/reviewing contract documents, or signing the contract and sample. There are five government agencies and five contractors, with five people assigned to each agency for questionnaires, a total of 50 people, and one person for an interview, a total of 10 people, and the data on demographic factors were analyzed by distributing frequencies, percentages, and skewness. Mean and standard deviation were used to analyze data and rank factors for preparing contracts and guarantees for design and construction supervision work with the Relative Importance Index (RII), as well as ranking guidelines for further improving the form of contracts and guarantees for design or construction supervision work with Severity Index (SI). The results of the study concluded that the format for preparing contracts and guarantees for design or construction supervision of government agencies and contractors still adheres to the guidelines of the Comptroller General's Department. The factor that most affects the preparation of contracts and guarantees for government agencies and contractors is the contract form factor, item 5, construction control contract with an RII of 96.00%, and the least is the form factor, item 2. The format for preparing contracts and guarantees for the agency's design or construction supervision differs from the format of the Comptroller General's Department, with an RII of 30.64%. In this research, it was also found that there are guidelines for further improving the format, preparing contracts and guarantees for design or construction control work to be efficient and minimize the impact on the preparation of contracts and guarantees as much as possible, including contract elements. As for the contract's content, the scope of the agreement and documents attached to the contract have the SI value of 96.80%.
