An Analysis of the Main Principles of Legal Philosophy Appearing In The Dutiyaparajika from the Samantapasadika Scriptures

Abstract
This research aimed to: 1) study theoretical concepts of legal philosophy, 2) examine the content and key principles of the Dutiyaparajika as presented in the Samantapasadika scripture, and 3) analyze the principles of legal philosophy reflected in the Dutiyaparajika according to the Samantapasadika commentary. This research was qualitative, employing documentary research through content analysis of the Tripitaka, Buddhist commentaries, academic literature, and related research studies.
The findings revealed that legal philosophy refers to the body of knowledge concerned with the nature and foundations of law, emphasizing interpretations grounded in morality and justice. The principles of legal philosophy appearing in the Dutiyaparajika of the Samantapasadika demonstrate that the disciplinary rules of Buddhism (Vinaya) serve not only to maintain the purity and orderliness of the monastic community but also connect significantly to principles of justice and societal laws, particularly regarding the act of theft. The Dutiyaparajika clearly parallels secular criminal law, illustrating the interrelationship between Buddhist discipline and general legal principles governing society. The results of this study provide valuable insights for interpreting and applying Buddhist disciplinary rules in contemporary contexts characterized by increased complexity. Furthermore, the research highlights the significance of the Samantapasadika commentary in preserving and transmitting the Buddhist Vinaya effectively within the modern era.
