อาเซียนกับปัญหาอาชญากรรมทางทะเลในเอเชียตะวันออกเฉียงใต้

บทคัดย่อ

ปัญหาอาชญากรรมทางทะเล เป็นประเด็นความมั่นคงใหม่ที่สำคัญปัญหาหนึ่ง ในช่วงกว่า 2 ทศวรรษที่ผ่านมา ประเทศในกลุ่มอาเซียนและเอเชียตะวันออกได้แสวงหาหนทางในการแก้ปัญหาดังกล่าวร่วมกัน อย่างไรก็ดี ความร่วมมือต้องประสบกับความท้าทายหลายประการด้วยกัน ซึ่งก็รวมทั้งคำถามเกี่ยวกับอำนาจอธิปไตยแห่งรัฐและการแข่งขันกันในการมีบทบาท บทความนี้มุ่งทบทวนวิวัฒนาการความร่วมมือเพื่อต่อต้านอาชญากรรมทางทะเลในภูมิภาค นอกจากนั้นยังโต้แย้งว่าแนวทางการแก้ปัญหาในปัจจุบันนั้นมีข้อจำกัดหลักๆ 2 ประการ คือ (1) ความหวาดระแวงซึ่งกันและกันของประเทศสมาชิก ซึ่งนำไปสู่ความร่วมมือแบบหลวม และการต้องพึ่งพาประเทศสมาชิก และ (2) การละเลยปัญหาพื้นฐานที่ก่อให้เกิดอาชญากรรมทางทะเลรวมทั้งประเด็นอื่นๆที่เกี่ยวข้อง ส่วนท้ายของบทความนี้เสนอว่า นอกจากการบังคับใช้กฎหมายอย่างมีประสิทธิภาพในระดับชาติและการสร้างกฎหมายในระดับนานาชาติแล้ว การแก้ปัญหาระยะยาวที่มีความเป็นไปได้นั้นขึ้นอยู่กับการแก้ปัญหาเศรษฐกิจและสังคมและความพยายามของรัฐในการรวมพื้นที่ตามชายฝั่งที่ห่างไกลเข้าเป็นส่วนหนึ่งของนโยบายภูมิภาคนิยม
